《邯郸市大气污染防治办法》已经2019年12月6日邯郸市人民政府第48次常务会议审议通过，现予公布，自2020年3月1日起施行。

The “Measures of Handan Municipality on the Prevention and Control of Atmospheric Pollution”, which was adopted on the 48th executive meeting of Handan Municipal People’s Government of December 6th, 2019, is hereby promulgated and shall come into force on March 1st, 2020.

Measures of Handan Municipality on the Prevention and Control of Atmospheric Pollution

第一章 总 则

Chapter I  General Provisions

第一条 为防治大气污染，保护和改善大气环境，保障公众健康，推进生态文明建设，根据《中华人民共和国大气污染防治法》《河北省大气污染防治条例》等有关法律、法规，结合本市实际，制定本办法。

Article 1  These measures are formulated in accordance with the relevant laws and regulations such as the “Law of the People's Republic of China on the Prevention and Control of Atmospheric Pollution”, the “Regulations of Hebei province on the Prevention and Control of Atmospheric Pollution”, and with full consideration to the actual circumstances of this Municipality, for the purpose of preventing and controlling atmospheric pollution, protecting and improving the atmospheric environment, safeguarding human health, and promoting ecological civilization construction.

第二条 本办法适用于本市行政区域内的大气污染防治。

Article 2  These measures shall apply to the prevention and control of atmospheric pollution within the administrative areas of this Municipality.

第三条 市、县（市、区）、乡镇政府（街道办事处）对本辖区内的大气环境质量负责。

Article 3 The governments of Handan Municipality, counties (including districts and Wuan City), towns and townships (including sub-district offices) shall be responsible for the quality of the atmospheric environment under their own jurisdictions.

市、县（市、区）政府应当将大气污染防治工作纳入国民经济和社会发展规划以及年度工作计划，保障大气污染防治的财政投入。

The governments of Handan Municipality, counties (including districts and Wuan City) shall incorporate the protection of the atmospheric environment into their national economic and social development plans and their annual work plans, and ensure the financial input for the prevention and control of atmospheric pollution.

第四条 市、县（市、区）政府应当根据大气污染防治的要求，加强整体统筹协调，建立统一有效、分工明确的监管治理体系。

Article 4 The governments of Handan Municipality, counties (including districts and Wuan City) shall, in accordance with the requirements for the prevention and control of atmospheric pollution, strengthen overall coordination and establish a unified, effective supervision and governance system with clear division of responsibilities.

乡镇政府（街道办事处）在县（市、区）政府的指导下，组织开展大气污染防治工作。

The governments of towns and townships (sub-district offices) shall, under the guidance of the governments of counties (districts and Wuan City), carry out the work of prevention and control of atmospheric pollution.

生态环境部门对大气污染防治实施统一监督管理，有关部门根据各自职责对大气污染防治实施监督管理。

The administrative departments of ecology and environment shall be the instrument conducting unified supervision and management of the prevention and control of atmospheric pollution. And the relevant administrative departments shall, within their respective functions, supervise and administer the prevention and control of atmospheric pollution.

第五条 公民应当增强大气环境保护意识，采取低碳、节俭的生活方式，自觉履行大气环境保护义务。

Article 5  Citizens shall enhance their awareness of protecting the atmospheric environment, taking a low-carbon and frugal lifestyle and consciously perform the obligations in relation to protection of atmospheric environment

第二章 监督管理

Chapter II  Supervision and Administration

第六条 市、县（市、区）政府应当将大气污染防治目标责任书和大气污染防治计划完成情况纳入生态环境责任考核范围，考核结果应当向社会公开。

Article 6  The governments of Handan Municipality, counties (including districts and Wuan City) shall incorporate the target responsibility statement for the prevention and control of atmospheric pollution and the fulfillment of the plan for the prevention and control of atmospheric pollution into the scope of the ecological and environmental performance evaluation. The evaluation results shall be made public.

第七条 市、县（市、区）政府按照全面覆盖、属地管理、分级负责、责权分明的原则，实行县（市、区）、乡镇（街道）、村（社区）网格化监管，建立和完善网格化的大气生态环境监管机制，明确监管对象、监管内容、监管标准和网格长、网格员。

Article 7  The governments of Handan Municipality, counties (including districts and Wuan City) shall follow the principle of “Full Coverage, Territorial Management, Graded Responsibility, Clear Duties and Responsibilities”, carry out the grid management in counties (districts and City), towns & townships (sub-district offices), villages (communities), establish and improve meshing scheme of atmospheric ecology and environment, and define the regulatory object, content, standard, chief grid steward and its clerk.

第八条　取得排污许可证的单位应当按照排污许可证载明的环境管理要求进行生产经营活动，不得超过许可的种类、数量和浓度等排放大气污染物。

Article 8  The units that have obtained a pollutant discharge permit shall engage in production and business dealings in accordance with the requirements specified in the pollutant discharge permit, and may not discharge atmospheric pollutants in excess of category, quantity or concentration specified in permit.

市、县（市、区）政府依法制定的环境质量限期达标规划、重污染天气应对及生产调控措施，要求排污单位执行更加严格的重点污染物排放总量控制指标的，应当在排污许可证副本中规定。

When the governments of Handan Municipality, counties (including districts and Wuan City) formulate legally plans to reach relevant standards within a prescribed time period, take measures to respond to severe pollution weather, and require the pollutant discharging unit to implement the total discharge quota of key pollutants, the counterpart of pollutant discharge permit shall be stipulated.

第九条　各县（市、区）、冀南新区、邯郸经济技术开发区生态环境分局依据法律、法规、规章的规定，对本辖区内生态环境违法行为实施行政处罚。

Article 9  The ecology and environment sub-bureaus of counties (including districts and Wuan City), Jinan New Development Area and Handan Economic and Technological Development Zone shall, in accordance with the provisions of laws, regulations and rules, impose administrative sanctions on the illegal acts of ecology and environment within the jurisdiction.

第三章 防治措施

Chapter III  Prevention and Control Measures

第十条 市、县（市、区）政府应当调整能源结构，积极推进气代煤、电代煤等清洁能源替代工作，推广清洁能源的使用。

Article 10  The governments of Handan Municipality, counties (including districts and Wuan City)  shall adjust the energy structure, actively promote the replacement of coal by clean energy sources such as gas and electricity, and promote the use of clean energy.

发展改革部门应当根据经济发展状况和大气环境质量要求，结合上级下达的削减煤炭消费任务，制定煤炭消费总量控制计划及削减目标、措施，报同级政府批准后组织实施。

The departments of development and reform shall, in light of economic development conditions and the requirements for atmospheric environment quality, and in conjunction with the task of reducing coal consumption assigned by higher authorities, formulate plans of total coal consumption-controlled and the targets & measures of consumption-reduced, and shall report them to the government at the same level for approval before the implementation.

新建、改建、扩建涉煤炭项目应当符合本市煤炭消费总量控制要求，并实行煤炭等量或者减量替代。

Any new construction, reconstruction or expansion project involving coal shall meet the Municipal requirements of total coal consumption-controlled, and shall implement the alternative scheme of substitution of coal consumption by equal or reduced amount.

第十一条 禁止生产、加工、销售和使用劣质散煤。

Article 11  The production, processing, sale and use of inferior coal powder coal shall be prohibited.

第十二条 已实施清洁取暖的地区，由市、县（市、区）政府划定禁煤区。

Article 12  In areas where clean heating has been implemented, the governments of Handan Municipality, counties (including districts and Wuan City) shall designate a coal ban zone.

禁煤区范围内除集中供热和重点企业原料用煤外，禁止储存、销售和使用燃煤。

Within the banned coal area, the storage, sale and use of coal is prohibited except for the coal used as raw materials in central heating enterprises and key enterprises.

暂不具备清洁能源替代条件区域，推广使用洁净型煤等洁净燃料。

In areas where clean energy alternatives are not yet available, the clean fuels such as clean coal briquette should be promoted.

第十三条 市、县（市、区）政府应当根据大气污染物排放控制标准和本地大气污染物排放状况，进一步优化产业布局，实施重污染企业搬迁改造或者关闭退出，对重点行业企业进行超低排放改造和无组织排放治理。

Article 13  The governments of Handan Municipality, counties (including districts and Wuan City) shall, in accordance with the standards for atmospheric pollutants discharge control and the local conditions for the atmospheric pollutants discharge, further optimize the industrial distribution and layout, implement the relocation, transformation or shutting down of enterprises with heavy pollution, and carry out the transformation of ultra-low discharge and irregular discharge without passing through the exhaust funnel of enterprises in key industries.

第十四条 工业生产、垃圾填埋或者其他活动产生的一氧化碳等可燃性气体应当回收利用，不具备回收利用条件的，应当进行污染防治处理。

Article 14  Combustible gases such as carbon monoxide produced by industrial production, landfill or other activities shall be recycled and utilized. In the absence of such conditions, pollution prevention and control shall be carried out.

一氧化碳等可燃性气体回收利用装置不能正常作业的，应当及时修复或者更新。

Where the equipment for the recovery and utilization of combustible gases such as carbon monoxide is unable to operate normally, it shall be repaired or updated in time.

在回收利用装置不能正常作业期间确需排放一氧化碳等可燃性气体的，应当充分燃烧或者采取其他控制大气污染物排放的措施，并向当地生态环境部门报告，按照要求限期修复或者更新。

If it is really necessary to discharge combustible gases such as carbon monoxide during the period when the recovery and utilization device cannot operate normally, it shall be fully burned or other measures shall be taken to control the discharge of atmospheric pollutants, and shall be reported to the local administrative departments of ecology and environment for repair or renewal within a time limit as required.

第十五条　市生态环境部门应当会同有关部门、行业协会，制定相关行业的污染防治技术规范，引导化工、工业涂装、包装印刷、家具制造等重点行业逐步采用低挥发性有机物含量的产品，控制气态污染物的排放。

Article 15  The Municipal administrative departments of ecology and environment shall, together with the relevant departments and trade associations, formulate technical specifications for pollution prevention and control in relevant industries, guide key industries such as chemical industry, industrial painting, packaging & printing, and furniture manufacturing to gradually adopt products with low volatile organic content to control the emission of gaseous pollutants.

非工业园区不得新上化工、工业涂装、包装印刷、家具制造等生产经营项目。

Non-industrial parks shall not be allowed to carry out new production and business projects such as chemical industry, industrial painting, packaging & printing, and furniture manufacturing.

在人口密集区域和医院、学校、幼儿园、养老机构等其他需要特殊保护区域的现有化工、工业涂装、包装印刷、家具制造等生产经营项目，应当制定退出计划，尽快退出。

For the existing projects of production and business such as chemical industry, industrial coating, packaging & printing, furniture manufacturing in densely populated areas and other areas that need special protection, such as hospitals, schools, kindergartens, elderly care institutions, an exit plan shall be formulated and the existing projects should be phased out as soon as possible.

退出计划由市、县（市、区）政府制定。

The exit plan shall be formulated by the governments of Handan Municipality, counties (including districts and Wuan City).

第十六条　化工以及生产、使用和储存挥发性有机物的企业在计划开工、维修、检修、停工过程中，应当按照规定对生产、储存装置的停运、倒空、清洗等环节实施挥发性有机物排放控制。

Article 16  When the chemical industry and the enterprises that produce, use and store volatile organic compounds are going to run, repair, overhaul and suspend production, they shall, in accordance with relevant provisions, control the emission of volatile organic compounds in the process of decommissioning, emptying and cleaning of devices of production and storage.

第十七条　加油站、储油库应当安装油气回收装置，保持正常使用，确保油气达标排放，并与生态环境部门联网。

Article 17  Petrol stations and oil storage depots shall install oil and gas recovery equipment, keep them to be working in a good condition to ensure the up-to-standard release of oil and gas. And a network connection shall be gained with the administrative departments of ecology and environment.

第十八条　排放油烟的餐饮服务业经营者和单位食堂应当安装油烟净化设施，保持正常使用，定期清洗、维护并按规定保存记录。

Article 18  The operators of catering service and the staff’s cafeteria (dining hall) that discharge greasy fume from their restaurants shall install the facilities of fume purification, keep them to be working in a good condition, clean and maintain them regularly and keep records in accordance with regulations.

第十九条　机关、事业单位、国有企业以及城市公共交通、环境卫生、渣土运输等行业，应当推广使用清洁能源机动车，鼓励其他单位和个人使用清洁能源机动车。

Article 19  Government agencies, public institutions, state-owned enterprises, urban public transport, environmental sanitation, construction waste transportation and other industries shall promote the use of clean energy vehicles. Other units and individuals are encouraged to use clean energy vehicles.

每年新增或者更新的城市公共汽车应当全部选用清洁能源汽车。

All city buses newly added or updated each year should be powered by clean energy.

第二十条　在用机动车和非道路移动机械，其尾气不得超过标准排放。

Article 20  The exhaust emissions of motor vehicles and non-road mobile machinery in service shall not exceed the standard emissions.

机动车和非道路移动机械所有者或者使用者应当保证排放污染控制装置的正常运行，不得擅自拆除、闲置或者改装。

The owners or users of motor vehicles and non-road mobile machinery shall ensure the normal operation of the pollution-control devices, and the devices are not forbidden to dismantle, idle or refit it without authorization.

符合条件的在用重型柴油货车应当加装超标排放自动诊断系统，保证正常使用且与生态环境部门联网。

The qualified heavy-duty diesel trucks in service shall be equipped with an automatic diagnosis system for excessive discharge, so as to ensure normal use and a network connection shall be gained with the administrative departments of ecology and environment.

第二十一条　机动车排放检验机构应当按照国家规范，对机动车进行排放检验，并与生态环境部门联网。

Article 21  The motor vehicle emission inspection institutions shall, in accordance with the national standards, conduct emission inspection on motor vehicles, and a network connection shall be gained with the administrative departments of ecology and environment.

机动车排放检验机构对检验数据的真实性和准确性负责。

The motor vehicle emission inspection institutions shall be responsible for the authenticity and accuracy of the inspection data.

第二十二条 交通运输部门应当将机动车排气污染防治纳入对车辆营运、维修的监督管理内容，向社会公布具有机动车排气污染维修治理能力的维修机构名录。

Article 22  The transportation departments shall incorporate the prevention and control of motor vehicle emission in the supervision and management of vehicle operation and maintenance, and publish to the public a qualification list of maintenance entities of the maintenance and control of vehicle emission.

前款确定的机动车维修机构应当与交通运输、生态环境等部门建立机动车排气污染维修治理、环保检测数据联网共享机制。

The motor vehicle maintenance entities specified in the preceding paragraph shall establish a network-sharing mechanism with the departments of transportation, ecology and environment for the maintenance and treatment of motor vehicle and the data of environmental teat.

第二十三条　在用的非道路移动机械应当加装电子标签，保证正常使用且与生态环境主管部门联网，每年应当进行排气检验，凭检验合格报告进行信息登记编码。

Article 23  Non-road mobile machinery in service shall be equipped with electronic labels to ensure it under a good condition and in a network connection with the departments of ecology and environment. The exhaust inspection shall be carried out every year, and the information shall be registered and coded by the inspection report.

建设、水利、城管执法、交通运输等部门应当督促施工单位或者个人对使用的非道路移动机械在指定的平台上进行信息登记编码。

The departments of construction, water conservancy, comprehensive law enforcement of city management, and transportation shall urge the construction units or individuals to register and code the information of the non-road mobile machinery on the specified information platform.

禁止使用排放不达标和未登记编码的非道路移动机械。

It is prohibited to use non-road mobile machinery with sub-standard emissions and unregistered codes.

第二十四条　市、县（市、区）政府可以根据大气环境质量状况，划定并公布限制高排放柴油货车通行的区域。

Article 24  Areas of restricted passage can be defined and announced by the governments of Handan Municipality, counties (including districts and Wuan City) in light of the quality of the atmospheric environment.

第二十五条　生态环境部门可以通过黑烟抓拍、遥感监测等技术手段对在道路上行驶的机动车大气污染物排放状况进行监督抽测，公安机关交通管理部门应当予以配合。

Article 25  The administrative departments of ecology and environment may use smoke detection, remote sensing monitoring and other technical means to carry out supervision and sampling on the air pollutant emissions of motor vehicles driving on roads, and the traffic administrative department of public security organs should cooperate.

第二十六条 建设单位应当将防治扬尘污染的费用足额列入工程造价，并在施工承包合同中明确扬尘污染防治责任。

Article 26 A construction unit shall include the full cost of the prevention and control of dust pollution in the project cost, and shall clearly specify the responsibility for prevention and control of dust pollution in the construction contract.

暂时不能开工的工地，应当对裸露地面进行覆盖；

The exposed ground in the construction site that is temporarily unable to start construction shall be covered;

超过3个月的，应当进行绿化、铺装或者遮盖。

If it is over 3 months, it should be greened, paved or covered..

建设单位应当按照标准和要求在施工工地安装远程视频监控和扬尘在线监测设施，与建设、生态环境等部门的监控系统联网并保持正常运行。

The construction unit shall, in accordance with the standards and requirements, install remote video monitoring and online dust monitoring facilities at the construction site. And a network connection shall be gained with the departments of ecology and environment, and kept in a good condition.

第二十七条　施工单位应当制定具体的扬尘污染防治实施方案，在施工工地公示扬尘污染防治措施、负责人、扬尘监督管理主管部门等信息。

Article 27  Construction unit shall formulate a specific plan for the prevention and control of dust pollution, and publicize information on the measures for prevention and control of dust pollution, the person in charge, and the competent department of dust supervision and management at the construction site.

第二十八条　建立扬尘污染防治先期介入制度。

Article 28 An early intervention system for prevention and control of dust pollution shall be established.

行政审批部门核发建筑工程施工许可证后，通过审批管理信息系统同步推送至同级生态环境部门。

After the administrative department of review and approval issues the construction permit, it will be simultaneously sent to the administrative departments of ecology and environment at the same level through the system of examination and approval management information.

第二十九条　建设部门应当将扬尘管理工作信息纳入建筑市场信用管理体系，违法情节严重的，列入建筑市场主体黑名单。

Article 29  The construction department shall incorporate the information of dust management into the credit management system of the construction market. Those who have serious violations of these Measures shall be included in the blacklist of the construction market entities.

第三十条 市、县（市、区）、乡镇政府（街道办事处）应当根据秸秆资源情况和综合利用现状，因地制宜，科学确定秸秆综合利用的发展目标，并组织落实。

Article 30  The governments of Handan Municipality, counties (including districts and Wuan City), towns and townships (sub-district offices) shall scientifically determine the development goals of straw comprehensive utilization in light of the situation of straw resources and comprehensive utilization and the current status of comprehensive utilization, and shall implement accordingly.

禁止露天焚烧秸秆、树叶、杂草、垃圾等。

It is forbidden to burn straw, leaves, weeds, garbage, etc. in the in the open atmospheric environment.

第三十一条 市、县（市、区）、乡镇政府（街道办事处）应当提倡和鼓励移风易俗，引导公民文明、绿色祭祀，加强对祭祀活动的监督管理，在传统祭祀节日确定焚烧范围。

Article 31  The governments of Handan Municipality, counties (including districts and Wuan City), towns and townships (sub-district offices) shall advocate and encourage altering old customs, guide citizens to conduct sacrifices in a civilized and green way, strengthen supervision and administration of sacrificial activities, and designate the burning areas during the traditional festivals of sacrifice.

第三十二条 市、县（市、区）政府应当根据本辖区的实际情况，依法合理确定禁止或者限制燃放烟花爆竹的区域、时段和种类，并向社会公布。

Article 32  The governments of Handan Municipality, counties (including districts and Wuan City) shall reasonably determine the areas, time periods and types of fireworks that are banned or restricted in accordance with the law, and publicize them to the public. in light of the actual conditions in its jurisdiction, and make them publicly available.

第三十三条 市、县（市、区）政府应当制定重污染天气应急预案，根据重污染天气预警等级，依法启动应急预案。

Article 33  The governments of Handan Municipality, counties (including districts and Wuan City) shall formulate emergency response plans for severely polluted weather, and start the response plans in accordance with the law on the basis of the warning grade of the severely polluted weather.

在应急响应期间，重污染天气应急预案所涉及的企业应当按照要求落实应急响应措施。

During the period of emergency response, enterprises involved in emergency p response plans for severely polluted weather shall implement emergency response measures as required.

第三十四条 市、县（市、区）政府可以根据本行政区域大气环境质量改善目标，在重点区域、重点行业组织推行生产调控。

Article 34  The governments of Handan Municipality, counties (including districts and Wuan City) shall organize and exercise production control in key regions and industries according to the goals of improving the atmospheric environmental quality in their respective administrative regions.

生态环境部门应当会同相关部门制定生产调控方案，听取相关企业意见并组织专家论证，报同级政府批准后组织实施。

The administrative departments of ecology and environment shall, in conjunction with the relevant departments, formulate production control plans, listen to the opinions of relevant enterprises and organize expert argumentation, and organize their implementation after approval by the government at the same level..

执行生产调控管理的企业，应当按照规定对生产调控期间的生产经营活动进行调整，减少或者停止排放大气污染物的生产作业和运输等活动。

Enterprises that exercise production control plans shall, in accordance with relevant regulations, adjust their production and business operations during the period of production control, and reduce or stop the production, operation, transportation and other activities that emit atmospheric pollutants..

第四章 法律责任

Chapter IV  Legal Liability

第三十五条 违反本办法第十二条规定，在禁煤区销售燃煤的，由市场监管部门按照《中华人民共和国大气污染防治法》第一百零三条的规定予以处罚。

Article 35  Whoever, in violation of Article 12 of these Measures, sells coal in areas where coal is prohibited, shall be punished by the market supervision department in accordance with the Article 103 of the “Law of the People's Republic of China on the Prevention and Control of Atmospheric Pollution”.

第三十六条 违反本办法第十四条规定，工业生产、垃圾填埋或者其他活动中产生的一氧化碳等可燃性气体未回收利用，不具备回收利用条件未进行防治污染处理，或者可燃性气体回收利用装置不能正常作业，未及时修复或者更新的，由生态环境部门按照《中华人民共和国大气污染防治法》第一百零八条的规定予以处罚。

Article 36  Whoever, in violation of Article 14 of these Measures, fails to recycle and utilize combustible gases such as carbon monoxide generated in industrial production, landfill or other activities; fails to meet conditions for recycling and the prevention and control of pollution are not performed; or fails to repair and update timely the devices of flammable gas recovery and utilization for normal operations, shall be punished by the administrative departments of ecology and environment in accordance with the Article 108 of the “Law of the People's Republic of China on the Prevention and Control of Atmospheric Pollution”.

第三十七条 违反本办法第十七条规定，加油站、储油库未按照国家有关规定安装使用油气回收装置的，由生态环境部门责令改正，可以处以2万元以上10万元以下的罚款。

Article 37  Whoever, in violation of Article 17 of these Measures, fails to install and use oil and gas recovery devices in a petrol station or an oil storage depot in accordance with the relevant national provisions, shall be ordered to make corrections and imposed a fined of 20,000 to 100,000 Chinese Renminbi Yuan (hereinafter referred to as “CNY”) by the administrative departments of ecology and environment.

第三十八条 违反本办法第十八条规定，排放油烟的餐饮服务经营者，未安装油烟净化设施、不正常使用油烟净化设施或者未采取其他油烟净化措施，超过排放标准排放油烟的，由生态环境部门按照《中华人民共和国大气污染防治法》第一百一十八条第一款的规定予以查处；

Article 38  Those catering service operators, in violation of Article 18 of these Measures, fail to install the facilities of fume purification, fail to use facilities of fume purification normally, or fail to take other measures to purify lampblack, so as to discharge lampblack beyond the emission standard, shall be investigated and penalized by the administrative departments of ecology and environment according to the first paragraph of Article 118 of Law of the “People's Republic of China on the Prevention and Control of Atmospheric Pollution”.

有露天烧烤等店外经营及占道经营行为的，由城管执法部门负责取缔；

If there are business activities outside the store such as outdoor barbecue as well as occupying the road, they shall be banned by the department of comprehensive law enforcement of city management.

需要吊销营业执照或者食品生产经营许可证的，由市场监管部门依法作出决定。

If it is necessary to revoke the business license or food production marketing license, the market supervision department shall make a decision in conformity with law.

在居民住宅楼等非商用建筑、未设立配套规划专用烟道的商住综合楼、商住综合楼内与居住层相邻的楼层内新建、改建、扩建产生油烟、异味、废气的餐饮服务项目的，由生态环境部门按照《河北省大气污染防治条例》第九十条的规定予以查处，城管执法、市场监管部门按前款分工负责相关工作。

Whoever conducts new construction, reconstruction and expansion of catering services that produce lampblack, peculiar smell or exhaust gas in non-commercial buildings such as residential buildings, commercial/residential complex buildings without special flue pipe planning, and the floor adjacent to the residential floor in the commercial/residential complex buildings, shall be investigated and penalized by the administrative departments of ecology and environment in accordance with the Article 90 of the “Measures of Hebei Province on the Prevention and Control of Atmospheric Pollution”. The departments of comprehensive law enforcement of city management and market supervision shall perform their duties according to the preceding paragraphs.

第三十九条　违反本办法第二十四条、第二十五条规定，驾驶高排放柴油货车在禁止区域行驶，驾驶排放黑烟等可视污染物的机动车上路行驶或者驾驶经遥感监测超过标准排放大气污染物的机动车上路行驶的，由公安机关交通管理部门依法处罚。

Article 39  Whoever, in violation of Articles 24 and 25 of these Measures, drives high-emission diesel trucks in prohibited areas, drives motor vehicles that emit visible pollutants such as black smoke, or drives motor vehicles that emit air pollutants beyond the standard tested by remote sensing monitoring on the road shall be punished by the traffic administrative department of public security organs according to law.

第四十条　违反本办法第三十四条规定，未按要求执行生产调控管理措施的企业，由生态环境部门责令限期改正，可以处以2万元以上10万元以下罚款，并纳入企业环境信用评价系统。

Article 40  Those enterprises, in violation of Article 34 of these Measures, fail to implement the production control and management measures as required, shall be ordered to make corrections within a time limit, fined 20,000 to 100,000 CNY and incorporated into the enterprise environmental credit evaluation system by the administrative departments of ecology and environment.

第四十一条 违反本办法规定的其他行为，法律法规已有处罚规定的，从其规定，构成犯罪的，依法追究刑事责任。

Article 41  For other acts in violation of the these Measures, if there are penalties provided by laws and regulations, those provisions shall prevail. Those violate these Measures and constitute a criminal offense shall be investigated for criminal liabilities in accordance with the law。

第五章 附 则

Chapter V  Supplementary Provisions

    第四十二条　冀南新区、邯郸经济技术开发区管委会根据本办法规定，负责托管区域内大气污染防治工作。

Article 42  The administrative committees of Jinan New Area and Handan Economic & Technological Development Zone shall, in accordance with these Measures, be responsible for the prevention and control of atmospheric pollution within the trusteeship area.

第四十三条　本办法自2020年3月1日起施行。2005年9月6日邯郸市人民政府令第108号公布的《邯郸市主城区大气污染防治管理办法》同时废止。

Article 43  These measures shall come into force on March 1st, 2020.The “Administrative Measures for the Prevention and Control of Air Pollution in the Main Urban Area of Handan City” promulgated by Order No.108 of Handan Municipal People's Government on September 6, 2005 was simultaneously abolished.
